• BETWEEN: Care For Kidz Nanny Agency Pty Ltd ACN 130 385 769 ("Care For Kidz") AND The undersigned ("you")
  
  Care for Kidz provides permanent babysitters/nannies/mothers helpers on the terms contained in this agreement:
  
  1. Engagement. Care For Kidz will introduce or arrange permanent placements of permanent staff (employees) to you (employer) at the place or dates nominated. Your relationship with Care For Kidz is one of principal and agent. Nothing in this agreement is intended to create a relationship of employer and employee between you and Care For Kidz either generally or under this agreement. Introduction are confidential and as a result of an introduction made by Care for Kidz to you, you are subsequently engaged on a permanent basis on referral by you to any other person or organisation, then you will be liable for the payment specified in Item 1 of the schedule as if you engaged the applicant.
  
  2. Payments by You you will pay Care For Kidz the agency fee specified in Item 1 of the Schedule when you engage a permanent staff (employee) introduced to you by Care for Kidz, by the due date. Late payments will incur a five percent (5%) monthly charge.
  
  3. Placement fees are payable as specified in item 1 in the schedule. It is payable within one (1) week of date of invoice. Should the permanent staff (employee) be unsuitable within the first six (6) weeks of employment Care for Kidz will make every effort to replace the permanent staff (employee) at no charge. Care for Kidz will only make one (1) replacement per permanent placement. This will only apply if our account has be paid/received by the due date. The six (6) week period starts from the first day of employment. If your circumstances change within the eight period and you do not require a nanny, then a daily agency fee of $25 (twenty five dollars) will apply.
  
  CARE FOR KIDZ RESERVES THE RIGHT TO REFUSE REPLACEMENT IF WE BELIEVE THAT CARER HAS BEEN HARASSED OR MISTREATED IN ANY WAY EMOTIONALLY, PHYSICALLY, OR MENTALLY.
  
  4. Principal/Agent Your relationship with Care for Kidz is one of principal and agent. Nothing in this agreement is intended to create a relationship of employer and employee between you and Care for Kidz either generally or in relation to any one or more of your obligations under this agreement or a relationship of principal and contractor.
  
  5. Exclusivity If you agree to use Care for Kidz as your exclusive agency, Care for Kidz will advertise the position available through our web site & local newspapers (if necessary) on your behalf. In the event of you canceling your application form, you agree to pay Care for Kidz one hundred dollars ($100) to cover administration costs
  
  6. Your Obligations:
  
  • You must provide Care for Kidz with a completed Family Application Form
  
  • You are aware and agree to abide by all your statutory obligations of employing permanent staff, (employees)
  
  • You must provide details to permanent staff (employees) if there are any restraining orders in place or custody disputes to ensure the safety of your children full details including a description of the person or persons against whom the restraining order has been made.
  
  • provided a clean, safe and secure location.
  
  • Complete a workplace agreement between you (employer) and the Permanent staff (employee)
  
  
  7. Termination- either party may terminate this agreement by notice in writing to the other.
  
  8. Notices All notices and other communication required to be given under this agreement must be in writing and must be addressed to the principal place of business of the applicable party or such other address as that party may have notified the other party in writing, and shall be either be delivered personally or by pre paid post.
  
  9. Release and Indemnity While Care For Kidz uses its best efforts to satisfy itself that all potential permanent staff and babysitters it arranges for you are experienced are over 18 years of age who have a recognised first aid certificate, are registered carers, fit to undertake childcare duties, do not have a police record and will be reliable. It does not accept any liability for any loss or injury suffered or incurred by you or any of your children or damage to you, any of your children or your property directly or indirectly resulting from carrying out any duties under this agreement and you agree to indemnify and keep indemnified Care For Kidz with respect to any such loss or injury or damage whether or not caused directly or indirectly by any act, omission or negligence of Care For Kidz of any of its servants or agents. This release and indemnity continues forever.
  
  10. Statutory Obligations you are required to abide by all statutory obligations resulting from this agreement.
  
  
  SCHEDULE OF FEES
  
  
  Item 1: $1,495.00 + GST placement fee for a permanent nanny, mummy nanny, before/after school care, mothers help in Sydney    

• Item 2: $495 + GST placement fee for a au-pair

• Item 3: 10% of gross annual pay for a maternity nanny + GST

• Item 4: $2,500  (AUS)   placement fee for International placements + GST (10% of placement fee)
